2. LEGAL NOTICE

Any use of the website jeordiesmen.com (hereinafter: the Webshop) shall be subject to the terms and conditions set forth below. Documents, data, and information published on the Webshop may only be used for personal and non-commercial purposes, subject to compliance with all copyright and other intellectual property rights.

Any copying, reproduction, distribution, modification, public display, or commercial use of the content of the Webshop without prior written consent of KUBAK STIL d.o.o. (hereinafter: the Company) is strictly prohibited.

The Company makes reasonable efforts to ensure the accuracy, completeness, and timeliness of the information published on the Webshop, but does not guarantee that all information is complete, error-free, or up to date at all times.

Users use the Webshop at their own risk. The Company shall not be liable for any damage resulting from the use, inability to use, or reliance on information published on the Webshop.

The Company reserves the right to modify the content of the Webshop, as well as these Terms and Conditions, at any time and without prior notice.


3. GENERAL PROVISIONS

These Terms and Conditions (hereinafter: the Terms) govern the rights and obligations between the Company and users or customers regarding the use of the Webshop, product ordering, conclusion of distance sales contracts, payment, complaints, the right of unilateral contract termination, and other matters related to online purchases.

These Terms constitute:

  • pre-contractual information within the meaning of consumer protection regulations;

  • an integral part of every sales contract concluded via the Webshop;

  • the terms of use of the Webshop as an information society service.

By using the Webshop, the user confirms that they are familiar with these Terms, understand them, and fully accept them. The Company reserves the right to amend these Terms at any time, and all changes shall be published on the Webshop.


4. DEFINITIONS

Certain terms used in these Terms shall have the following meanings:

User – any person who accesses the Webshop via electronic communication means and uses it, regardless of whether they have concluded a sales contract through it.

Customer – any natural person who orders one or more products offered on the Webshop and whose order is accepted in accordance with these Terms.

Consumer – any natural person acting outside their trade, business, craft, or professional activity.

Sales Contract – a contract concluded between the Merchant and the Customer via means of distance communication.

Product – any item offered for sale through the Webshop.


5. USE OF THE WEBSHOP

Purchases through the Webshop are permitted exclusively to adults with full legal capacity. Minors or persons with limited legal capacity may use the Webshop only under the supervision and with the consent of a parent or legal guardian.

The User undertakes to:

  • provide accurate and complete information;

  • refrain from misuse of the system;

  • not use the Webshop for unlawful purposes.

The Company reserves the right to deny access to any User who abuses the Webshop or violates these Terms.

If you wish to order our products/goods through the website, it is necessary to create an account using your e-mail address.


6. ORDERING AND CONCLUSION OF CONTRACT

The possibility of ordering specific goods via the Webshop depends on product availability. Orders may be placed 24 hours a day, 7 days a week. Please note that products are selected based on photographs, which are illustrative in nature and may not correspond to the product in every detail.

To place an order, you must follow the ordering procedure and add selected products to your shopping cart. You may modify your order at any time until payment confirmation. After payment confirmation, we will notify you by e-mail that your order has been received.

If you have not received such notification but believe that you successfully placed an order, please contact us via the contact form.

If, due to extraordinary circumstances, we are unable to process your order, we will notify you without delay and reserve the right to cancel the order.


7. PRODUCT PRICES

All product prices displayed on the Webshop are stated in euros (EUR) and include value-added tax (VAT), unless explicitly stated otherwise.

The price displayed next to a particular product shall apply at the moment the order is submitted.

The Company makes reasonable efforts to ensure the accuracy of all published prices, product descriptions, and promotional information. Nevertheless, unintentional administrative, technical, or typographical errors may occur.

In the event of an obvious pricing error (for example, a price that significantly deviates from the market value of the product due to a technical or human error), the Company reserves the right to reject the order or unilaterally terminate an already concluded contract prior to product delivery.

In such case, any amount paid shall be refunded to the Customer without delay.

The Company reserves the right to change prices at any time without prior notice. Such changes shall not affect orders for which order acceptance confirmation has already been sent.

Information on product availability displayed on the Webshop is for informational purposes only and, due to a large number of orders, actual stock availability may differ from the displayed status. Therefore, the Company shall not be liable for any discrepancies in product availability, although it will make reasonable efforts to regularly update such information.

7.1. Special Types of Sales

The Company may occasionally organize:

  • promotional sales,

  • seasonal discounts,

  • clearance sales,

  • promotional campaigns,

  • special discounts and other benefits.

The terms of each promotional campaign, its duration, and any limitations shall be clearly indicated alongside the relevant offer.

Upon expiration of the promotional period, the Company shall not be obliged to accept orders under the conditions of that promotion.


8. PAYMENT METHODS AND ONLINE PAYMENT SECURITY

When paying on our web store, use Shopify Payments - an advanced system for secure acceptance of payment cards via the Internet. Shopify Payments ensures complete the confidentiality of your card data from the moment you enter it in the Shopify Payments payment form. Payment information is transmitted encrypted from your website browser to the bank that issued your card. Our store never does comes in contact with complete information about your payment card. Also, data is inaccessible even to Shopify Payments system employees. Isolated core independently transmits and manages sensitive data, while preserving it completely safe. The form for entering payment data is provided by SSL the transport code of the highest reliability. All stored data is optionally protected by encryption, using a certified cryptographic device according to FIPS 140-2 Level 3 standard. Shopify Payments meets all requirements related to the security of online payments prescribed by leading cardholders brands, i.e. operates in accordance with the standard - PCI DSS Level 1 - the highest security standard of the payment card industry. When paying by card included in the 3-D Secure program of your bank with the validity of the card itself additionally also confirms your identity with a token or password. Shopify Payments considers the collected information a bank secret and treats it accordingly. The information is used exclusively for the purposes for which it is intended. Your sensitive data is completely secure and their privacy is guaranteed the most modern protective mechanisms. Only the data necessary for performing work in accordance with prescribed demanding procedures for online payment. Security controls and operational procedures applied to our infrastructure ensure the current reliability of the Shopify Payments system. Besides maintaining strict access control, regular security monitoring and in-depth checks to prevent network vulnerabilities and planned by permanently maintaining information security provisions and improve the level of system security by protecting your card data.

The Company reserves the right to modify the available payment methods at any time.

An order shall be considered paid once the Company receives confirmation of successful authorization or payment execution from the payment service provider.

If payment authorization fails, the order cannot be completed.

The Company shall not be liable for security breaches beyond its reasonable control, including those occurring on the side of the bank, card issuers, or payment gateway providers.


9. DELIVERY OF PRODUCTS

The delivery of products is regulated by a separate document, the Shipping Policy.

10. MATERIAL DEFECTS

The Company shall be liable for material defects of products in accordance with the provisions of the Croatian Civil Obligations Act and other applicable laws of the Republic of Croatia.

A material defect exists in particular if:

  • the product does not have the characteristics necessary for its regular use;

  • the product does not have the characteristics required for a specific purpose for which the Customer purchases it, provided that such purpose was known to the Merchant;

  • the product does not correspond to the description, type, quantity, or quality agreed upon at the time of purchase.

The Customer is obliged to inspect the product upon receipt.

If the Customer notices a defect, they must notify the Company without undue delay.

The Company shall not be liable for damage resulting from improper use of the product, mechanical damage after delivery, normal wear and tear, or failure to follow maintenance instructions.


11. UNILATERAL TERMINATION OF CONTRACT

As a Consumer, you have the right to unilaterally terminate the contract within 14 days without stating any reason, with the period beginning on the day when you, or a third party designated by you, received the ordered goods.

In order to exercise your right of unilateral termination, you must notify the Seller, KUBAK STIL d.o.o., Samoborska cesta 145 E, Zagreb, of your decision to terminate the contract before the expiration of the above period, by submitting this Unilateral Termination form or by sending a clear statement expressing your intention to terminate the contract, containing your full name, address, telephone number, fax number (if applicable), e-mail address, and the contract/order you wish to terminate as a consumer. You may submit the statement or form via the contact form on the website or by postal mail to the Seller’s address stated above. We will provide you with confirmation of receipt of the notice of unilateral termination without delay via e-mail.

In the event of unilateral termination of the contract, you bear the cost of returning the goods and must return them to the Seller’s address stated above, undamaged, together with the corresponding label and invoice, via a postal service provider, no later than 14 days from the day you sent the notice of unilateral termination.

Please note that it is not possible to return goods that are unsuitable for return because they are sealed and lose quality once opened, or goods that have been customized for an individual customer or manufactured according to the customer’s specific measurements or requirements.

We will refund the payment without undue delay, within 14 days from receipt of the notice of unilateral termination, but not before the goods have been returned. Refunds will be made to the card used for payment. If the goods were paid for by cash on delivery, please contact us via the contact form regarding the refund method.

As a Consumer, you are responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functionality of the goods. If the goods are damaged in such a manner that they are no longer suitable for resale for reasons not attributable to the Seller, the Seller is not obliged to accept such return or refund the paid amount to the Customer. You will be notified accordingly via your e-mail address.

12. COMPLAINTS AND REPLACEMENT OF GOODS

In case the received goods do not correspond to the description of your order or are damaged, please contact us via the contact form. In relation to the return of goods, the conditions from Article 10 shall apply, and upon receipt and inspection of the goods, we will inform you about the possibilities of replacing the goods or your right to a refund of the amount paid.

If the goods have material defects, at your choice we will either deliver another defect-free product or refund the collected funds.

If the received goods are unsuitable due to size or model, but you wish to exchange them for other goods, please contact us via the contact form.

Please note that in the event of a complaint and/or replacement of goods, you must return the item together with the corresponding label and invoice.

13. LIMITATION OF LIABILITY

The User acknowledges the possibility of occasional service interruptions or technical difficulties beyond the control of the Company and accepts that the Company shall not be liable for any loss of data during transmission over the Internet.

The Company does not guarantee that the Webshop will be free from occasional errors, will always be available without interruption or that it will not contain technical issues caused by third parties.

The Company shall not be liable for interruptions in internet connection, technical failures beyond its control, consequences of unauthorized access to user accounts, damage caused by improper use of products.

To the maximum extent permitted by law, the Company’s total liability towards the Customer shall be limited to the purchase price of the specific product.

Users use the Webshop content at their own risk. The Company shall not be liable for any direct or indirect, incidental, intangible, or material damage arising from access to, use of, or inability to use the Webshop, except where such liability is explicitly prescribed by applicable law.

Nothing in these Terms excludes or limits consumer rights arising from mandatory legal provisions.


14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and all contracts concluded through the Webshop shall be governed by the laws of the Republic of Croatia.

Any disputes between the Company and the Customer shall first be attempted to be resolved amicably.

If an amicable settlement is not possible, disputes shall fall under the jurisdiction of the competent court in the Republic of Croatia, unless mandatory law provides otherwise.


15. PROCESSING OF PERSONAL DATA

The Company processes personal data in accordance with the Privacy Policy and Personal Data Protection Policy.

16. FINAL PROVISIONS

The Company reserves the right to amend and supplement these Terms at any time.

All amendments shall enter into force on the date of publication on the Webshop, unless explicitly stated otherwise.

The Terms applicable to the Customer shall be those in force at the time the order is placed.
